IP First Response is a pilot resource developed by IPAVentures which seeks to clarify how individuals and businesses can address potential intellectual property (IP) infringement. It does this by providing a simple point of entry containing general information for anyone wanting to understand IP enforcement pathways. It does not replace professional advice.
During its initial phase, a specific focus is placed on patents and trade marks, while user feedback helps refine the platform and shape further enhancements. This aims to strengthen confidence in IP protection, enhance the customer experience, and demonstrate IP Australia’s ongoing commitment of adapting to evolving user needs.
Why are we doing it?
Traditionally, IP enforcement has been the primary responsibility of IP owners. However, IPAVentures has identified that many small and medium enterprises (SMEs) and individual rights holders struggle to navigate enforcement pathways.
Through early research and stakeholder engagement, IPAVentures found:
- Limited visibility of enforcement options reduces the value of owning IP rights.
- Resource imbalances can disadvantage smaller businesses or individuals in enforcing their IP rights.
- Information gaps on negotiation or alternative resolution methods can leave many unsure of next steps.
IP First Response aims to address these challenges by making IP enforcement more accessible and understandable – without replacing professional advice.
What are we doing?
At the heart of this initiative is the development of a navigation aid that allows users to explore potential enforcement avenues, informed by what might be relevant to similar businesses.
How it works:
- Users answer a short series of questions about their situation.
- The site surfaces information that is most likely to be relevant, including general timeframes, costs and potential outcomes.
Note: The alpha version focuses on patents and trade marks, which form a substantial component of the inquiries IP Australia receives.
Collaboration with relevant government agencies, industry bodies, and professional networks also forms a core part of the pilot. By collaborating with these partners, we will engage with the main audiences of the tool and gather insights to improve the delivery of the service.
What have we learned so far?
Months of testing and research have highlighted a few key lessons:
- Transparency of information
Users value clear, step-by-step explanations about why certain enforcement options may be relevant to them. - Avoiding overwhelm
Presenting too many details at once can be confusing, so content needs to be introduced gradually and in an organised way. - User-friendly language
Even if individuals hold IP rights, complex legal terms and jargon can be a barrier. Clarity and plain language remain priorities.
